Some sort of setting restriction, perhaps, like a dead end? If the bad guys are taken alive, then either they don't have weapons where the police do, or their weapons are insufficient. They need to feel like capture is the best choice available to them, which means the alternative is serious injury or death (e.g., cops have them at gunpoint.)
